APOLOGIES FOR ABSENCE  \nCouncillor Harry Clarke \nCarol Richardson – Showfields \nGraham Thomas – North Warren \nRichard Parkin – Love Lane \nGary Spencer – Secretary of Foxby Hill Allotment Association \n2. DECLARATIONS OF INTEREST \nSimon Nicolson declared a pecuniary interest as a Spital Hill allotment holder\, but it was agreed that he would stay in the meeting to advise of any issues on his site.  The Deputy Clerk granted a dispensation for this purpose. \n 3. MINUTES OF THE PREVIOUS MEETING (Paper A) \nMinutes of the meeting of Allotments Sub-Committee Wednesday 27 January 2021. \nRESOLVED that the minutes of the   Allotments Sub-Committee held on Wednesday 27 January 2021 were approved as a correct record. \n4. ALLOTMENT SITE REPORTS (Paper B) \ni. FOXBY HILL\n No report submitted. \nii. LOVE LANE\nNo report submitted. \niii. NORTH WARREN \nThe secretary thanked the Council for the fence\, and requested for it to be looked into to having the water supply back on site. Also advised that Mr Smith had not received his letter of thanks from the Council. \nCllr Key advised he spoken with a plot holder and there was an issue with the keys for the gate locks on site. \niv. SHOWFIELD \nFollowing report was submitted: – \nRequested a letter be sent to remind plot holders about locking the gate as they have had issues with it being left open\, and to not leave rubbish around the skip once it is full. \nRequested that the ledger book is returned to her once the Council has logged all the details. \nRequested that all correspondence from the office to allotment holders is also sent to secretaries as this year some information has been missed. \nv. SPITAL HILL \nThanked the Grounds team for clearing some plots over the winter months. \nFeedback from plot holders following receipt of letters and survey’s. Confusion and upset regarding optional BACS payments and site inspections\, confusion regarding surveys and felt it was an invasion of privacy. \nRaised issues regarding a report for Community Services committee regarding plot numbers and sizes. \n5. ALLOTMENT BUDGETS (Paper C) \nMembers NOTED the budget update as provided. \n6. TOWN COUNCIL STRUCTURE AND ARRANGEMENTS (Paper D) \nThe Sub-committee NOTED the resolution of Full Council on 2nd March. \nRESOLVED to approve the proposal set out in section three of the report and for the matter to be considered again at the April 2021 meeting of Full Council. \nMembers considered the proposed draft of the new Structure and Functions document\, with particular reference to allotment management and the role and function of Site Secretaries. \nThe Chairman raised concerns that the current ‘The Guide to Terms and Conditions used in our Allotment Tenancy Agreement’ refers to an Allotment Sub-Committee\, and believes the Council are in breach of the agreement if the Sub-committee is dissolved. \n7. NEW ALLOTMENT TENANCY AGREEMENT \nThe Sub-committee NOTED the resolution of Community Services Committee on 9 February 2021. \nRESOLVED to approve of the new Agreement as set out at option 1 of the report\, as follows: \n\nThe new Agreement would be issued to all new plot holders from the date it is adopted;\nFoxby Hill Allotment Garden plot holders would be moved to the new Agreement from 1 April 2021 after it ceases to be self-managed\, and;\nUse of the new Agreement for all existing plot holders would start on Wednesday 17 March 2022 (one week before the allotment rent collection date).\nNotice would be given to existing plot holders by letter and email where possible. Notices would also be placed at each site\, on social media and on the Council’s website. \n\nThe Sub-committee considered initial feedback from new and existing plot holders. \n\nAllegedly proper notice has not been given\, plot holders haven’t been notified correctly that it is a change in the allotment tenancy agreement\, as the letter states new terms and conditions\nInspections\, wording has been changed from the National Allotment Society template tenancy agreement. Must be mutually agreed between both parties.\nCovenant – 8.1\, only the Council and land owner have sight of the lease document on the land\nFire arms on allotments – 11.4\, this section is not included in the National Allotment Society template\, the Council do not have a policy for Fire arms on allotments nor has a risk assessment been carried out\nPolicy – The Council does not have policy on inspections\, enforcement or on taking any disciplinary action against site secretaries\n\n  \n8. ALLOTMENT RENT REVIEW 2022/2023 \nSub-Committee NOTED the resolution made at Management and Finance Committee on Tuesday 16 February 2021: \n “RESOLVED that a 2% rent increase be set for 2022/2023” \nHowever\, due to an administration error\, plot holders were not given the 12month notice\, therefore the 2022/2023 rent will remain the same as 2021/2022. \n9. PIGEON POLICY (Paper E) \nSub-Committee NOTED the resolution made at Full Council on Tuesday 2 March 2021: \n“RESOLVED to adopt the Pigeon Policy with the inclusion of Cllr Dannatt’s amendments.” \n10. REQUESTS FOR WRITTEN PERMISION \nBoth requests were brought before Allotments Sub-Committee on 27 January 2021 \nCommittee NOTED the resolutions made at Community Services Committee on Tuesday 9 February 2021: \nLove Lane Site \n“RESOLVED to give retrospective written permission for the 1m high fence and for the area to be recognised as a plot\, subject to the condition that an appropriate access arrangement being agreed with the Operations Manager.” \nThis request was initially for the Love Lane Site at the last meeting the Sub-Committee “RESOLVED to defer any decision to a future meeting once the Pigeon Policy is in place.” However\, the plot holder chose to move to the North Warren Site. \n“RESOLVED to provide written permission to keep pigeons and install a pigeon loft at the North Warren Allotment Garden site on the proviso the dimensions comply with the draft Pigeon lofts and Keeping Pigeons Policy\, furthermore\, clearance works be approved providing they be kept within the existing allotment budget.” \n11. ALLOTMENT RENT COLLECTION \nSub-Committee NOTED the resolution made at a meeting of the Management and Finance Committee on Tuesday 16 February 2021: \n“RESOLVED to defer the collection of rents until 25 May 2021\, Management and Finance Committee to review at May 2021 meeting.” \nSimon Nicolson made a statement and advised that once a meeting of the Spital Hill Allotment Association could be called and the future of the water supply ascertain he would be resigning his post as plot secretary for Spital Hill allotments \nThe meeting concluded at 7.59pm.

MINUTES OF THE PREVIOUS MEETING (Paper A) \nMinutes of the meeting of Allotments Sub-Committee Thursday 1 October 2020 \nRESOLVED that the minutes of the   Allotments Sub-Committee held on Thursday 1 October 2020 were approved as a correct record. \n Note: Councillor Dobbie abstained from voting on the above resolution. \n4. ALLOTMENT SITE REPORTS (Paper B) \ni. LOVE LANE \nThe Chairman advised he had been in touch with the Secretary and he asked at what stage the complaint that went to Community Services Committee in November & December. Members were advised it would be at the February Community Services meeting for further discussion. \nCouncillor Dannatt requested that all reports for Members are in writing prior to the meeting. \n ii. NORTH WARREN \nThe secretary thanked the grounds maintenance staff for their prompt response in repairing the gate following a break in. \nThe Secretary asked the situation with the fence to be discussed at the Sub-committee meeting.          \niii.        SHOWFIELD \nFollowing report was submitted: – \nNot many problems on the allotments. Can we have a Covid sign for the gate as we keep having ours torn off. Also have you got a 5mile an hour sign ours has washes out. Main problem is people leaving the gate unlocked or open. \niv. SPITAL HILL  \nIt was reported there had been some intrusion on site\, sheds opened but no damage or items stolen. Updated signage was requested for all sites reminding tenants of Covid-19 protection measures. \n5. SELF MANAGED ALLOTMENT SITE REPORT \nIt was reported there had been intrusion on 22 December\, x3 rotavators stolen. Problems with scrap dealing from the site\, plot holder on final warning. \nMembers questioned the current finances for the Foxby Hill Allotments and asked if the £1\,000 management payment would be returned to the Council as it is coming back under the Council’s control. \nRESOLVED that a report regarding the Foxby Hill Allotments finance be reported to Management and Finance Committee. \n6. ALLOTMENT BUDGETS (Paper C) \nMembers NOTED the budget update as provided. \nRESOLVED TO RECOMMEND TO COMMUNITY SERVICES COMMITTEE that fencing works be carried out on North Warren allotment and both quotations be considered. \n7. ALLOTMENT RENT REVIEW 2022/2023 (Paper D) \nCommittee reviewed the 2022/2023 allotment rents. \nRESOLVED TO RECOMMEND TO MANAGEMENT AND FINANCE COMMITTEE that a 2% rent increase be set for 2022/2023 \nNote: Councillor Dobbie and Simon Nicholson voted against the above resolution. \n8. PIGEON POLICY (Paper E) \nCommittee considered a draft pigeon policy. \nBoth Councillor Dannatt\, Simon Nicholson and the Operations Manager had additions they wanted including in the policy. Member felt they didn’t want to wait until the next Allotments Sub-Committee to see the policy progress. \nRESOLVED that Members contact the Town Clerk with additions they would like to see in the pigeon policy\, then the draft policy be sent to Community Services Committee. \nNote: Councillor Dobbie and Simon Nicholson voted against the above resolution. \n9. REQUESTS FOR WRITTEN PERMISION (Paper F) \nThe Sub-Committee considered requests for written permission. \ni. Love Lane Allotments\, request to keep pigeons \nMembers noted that this request would contravene the current terms and conditions. \nRESOLVED to defer any decision to a future meeting once the Pigeon Policy is in place. \nii.Love Lane Allotments\, retrospective written permission request for the 1m high fence and for the area to be recognised as a plot \nThe Operations Manager advised that he saw no evidence that the plot floods or is constantly wet. \nRESOLVED TO RECOMMEND TO COMMUNITY SERVICES COMMITTEE to give retrospective written permission for the 1m high fence and for the area to be recognised as a plot\, subject to the condition that an appropriate access arrangement being agreed with the Operations Manager. \n10. LOVE LANE ALLOTMENT GARDENS ACCESS ROAD UPDATE (Paper G) \nCommittee noted an update about the Love Lane access road. \n11. ALLOTMENTS AND COVID SAFETY \nCommittee noted the resolution made at an extraordinary meeting of the Community Services Committee on Tuesday 19 January 2021: \n“RESOLVED to agree to: \ni. Issue a ‘final warning’ to five plot holders who breached the national legislation in accordance with the guidance received from NAS\, with a more specific letter issued to the Site Secretary;\nii. Issue a letter to the first complainant advising of how the complaint has been resolved and also regarding use of CCTV equipment and data protection;\niii. Issue a letter to the second complainant advising of how the complaint has been resolved\, and;\niv. The Town Clerk to provide a draft of the letters to the Leader of the Town Council and Chairman of Community Services Committee prior to them being sent.” \nCommittee considered how the sites could be made as secure as possible for all tenants\, staff\, and other approved users. \nRESOLVED TO RECOMMEND TO MANAGEMENT AND FINANCE COMMITTEE to defer the collection of rents\, and to bring back to the April meeting to set a date for rent collection. \nThe Operations Manager advised site secretaries that if the do not feel comfortable in doing so to not meet perspective new plot tenants until later in the year. \nCouncillor Dobbie proposed that all plot holders are contacted directly advising of their responsibilities and the government guidance\, signage be put on all sites advising of the same\, and social media and the website\, seconded by Simon Nicholson. \nCouncillor Boles proposed an amendment that all allotments guidance posters be updated to ensure current guidance and restrictions are advised\, seconded by Councillor Dannatt. \nThe amendment was voted on as follows: – \n3 votes for\n2 members abstained from voting \nRESOLVED TO RECOMMEND TO COMMUNITY SERVICES COMMITTEE that allotment guidance posters be updated to ensure current guidance and restrictions are advised. \nThe meeting concluded at 8.50pm.

Thank you for cutting back the dividing hedge between the allotments and Richmond park I’m told it has made a big difference. \nI have had a few problems with plot holders not willing or able to keep their plots tidy\, all but one has been sorted. \nI am happy to say Showfield allotments has been running along fine with no other problems. \n  \n  \n\n SPITAL HILL \n\n  \nIt was requested and RESOLVED TO RECOMMEND TO COMMUNITY SERVICES COMITTEE that: – \n\nsignage be provided for all sites reminding tenants of Covid-19 protection measures;\na supply of hand sanitiser is provided for each site\, and fix to the entrance area\nthe Operations Manager to conduct a risk assessment looking at the introduction of new potential tenants coming onto the site and the impact they may have.\n\n  \n  \n\n SELF MANAGED ALLOTMENT SITE REPORT\n\n  \nGary advised that he had nothing to report. \n  \n  \n\n ALLOTMENT BUDGETS (Paper C)\n\n  \nMembers NOTED the budget update as provided. \n  \nMembers noted the ear marked reserve position. Only specifications in the current terms and conditions state they must be kept on the North Warren site. \n  \nSite Secretary has advised he is happy for this loft to be erected but raised concerns regarding increase in vermin if more are allowed on site in future. \n  \nRESOLVED TO RECOMMEND TO COMMUNITY SERVICES COMMITTEE to approve the request from a plot holder to keep pigeons on their plot on North Warren allotments\, and look at producing a policy on the keeping of pigeons on the allotment\, stating the size of the loft and number of pigeons that can be kept. \n  \n  \n\nLove Lane Allotments\, request to keep pigeons\n\n  \nMembers noted that this request would contravene the current terms and conditions. \n  \nRESOLVED to defer any decision to a further meeting for further discussion\, pending the outcome of the complaint in agenda item 9. \n  \n  \niii.         Love Lane Allotments\, retrospective written permission request for the 1m high fence and for the area to be recognised as a plot \n  \nNote: Councillor Panter left the meeting at 7.50pm. \n  \nRESOLVED to defer any decision to the January meeting in order to get clarity on the state of the ground before adopting the area as a recognised plot and discussing the retrospective request to keep the fence. \n  \n  \n  \n  \n02 \n  \n  \n\n PLOTS 20/24 LOVE LANE ALLOTMENT SITE (Paper G)\n\n  \nThe Sub-Committee considered issues relating to a pigeon loft and fencing at plots 20/24 Love Lane Allotment Site. \n  \nIt was proposed by Councillor Dannatt and seconded by Councillor Boles that the plot holder be requested to remove the fencing around his allotment plot. \n  \nAt the request of Simon Nicolson a recorded vote was taken as follows: – \n  \nFor: – Councillors Boles\, Dannatt and Lambie\, and Simon Nicolson \n  \nRESOLVED TO RECOMMEND TO COMMUNITY SERVICES COMMITTEE that the fence on plots 20/24 Love Lane allotments be removed. \n  \n  \nMembers NOTED a review needs to take place on the permission granted on 30 July 2019 to ensure the plot holder still complies. \n  \n  \n  \n  \n  \n  \nCouncillor Boles advised he had received a complaint regarding bonfires on Showfield allotments. \n  \nNotices to be made for sites reminding plot holders to be aware of their surroundings when having bonfires as to not to cause a disturbance. \n  \n  \n  \n  \n  \nThe meeting concluded at 8.27pm.

He advised they had had some trespassers\, but nothing stolen or broken. \n  \n  \n6.             LOVE LANE ALLOTMENTS – MANAGEMENT MATTERS ARISING\n  \nRichard advised they had also had some trespassers and are aware of who it was. Some sheds were damaged but nothing stolen. \n  \nRichard advised they would like to extend the car park. The Operations Manager advised he would visit the site to measure the dimensions and get some prices and report back to the next meeting. \n  \n  \n7.             NORTH WARREN ALLOTMENTS – MANAGEMENT MATTERS ARISING\n  \nGraham advised that all was ok. \n  \n  \n8.             FOXBY HILL ALLOTMENT\n  \nGary advised that they still have issues with a plot holder who had their tenancy agreement terminated\, they are still accessing the site and has not returned their key. Also issues as the plot holder has brought asbestos on to site and the adjacent school and environmental health are now involved. \nCouncillor Dobbie advised he would assist the allotment site as WLDC Councillor for that ward as it could be deemed as flytipping. \n  \n  \n\nALLOTMENT BUDGETS (Paper B)\n\n  \nMembers NOTED the budget update as provided. \n  \n  \n\n2021 / 2022 RENT REVIEW (Paper C)\n\n  \nMembers reviewed the 2021 / 2022 allotment rents \n  \nRESOLVED TO PROPOSED TO MANAGEMENT AND FINANCE COMMITTEE a £1\nincrease for ¼ rood gardens and £2 for ½ rood gardens for 2021 / 2022. \n  \nSecretaries were asked about current availability for the sites. \n  \nRESOLVED to advertise plot vacancies on Facebook\, the Council website and notice boards to see if there is any further uptake. The Operations Manager referred to previous conversations with Acis at the end of 2018 who had advised that the works would be carried out within a twelve-month window but agreed to contact for update on scheduling. The Secretary referred to several polytunnels being slashed recently. \n  \n  \n\n SPITAL HILL ALLOTMENTS – MANAGEMENT MATTERS ARISING\n\n  \nThe Secretary thanked the Operations Manager for his assistance with a recent tenancy issue at the site. He then referred to the outstanding post repair work to the fence on Cox’s Hill side of the site. The Operations Manager noted that this was on the schedule of works. \n  \n  \n\n LOVE LANE ALLOTMENTS – MANAGEMENT MATTERS ARISING\n\n  \nThe Secretary advised that the site had been subject to a break in on one of the plots. He requested that the dyke on site be strimmed. The Operations Manager agreed to arrange this. \n  \n  \n\n NORTH WARREN ALLOTMENTS – MANAGEMENT MATTERS ARISING\n\n  \nThe Secretary informed Members of a break in at the site with damage to one plot and that the police were involved as there was some malicious damage. He referred to the recent clearance work carried out on site and that the area now needed ploughing to create plots for active cultivation. He enquired regards progress on lock changes at the site following non-return of a key by an outgoing plot holder. The Operations Manager advised that this had progressed and is now ready for a date to be agreed for the necessary works. \n  \nCllr Dobbie referred to the allotment watch scheme as a potential aid to deterring vandalism and theft across sites. \n  \n  \n\n ALLOTMENT BUDGETS (Paper B)\n\n  \nThe Clerk informed Members that Paper B would not be presented at the meeting as Officer resource to compile had not been available. The Clerk gave the Sub Committee a verbal update as follows: \n\nEarmarked reserves now at £3\,900.00 across the four sites – following works to Showfield wall and North Warren Road.\n\n  \n\n2019/20 budget includes provision for skips as before and plus a £500.00 miscellaneous expenses provision for each site.\n\n  \nRESOLVED that Members note the budget update as provided by the Clerk. \n  \n  \n\n FOXBY HILL ALLOTMENT\n\n  \nThe representative informed Members of the result of the recent AGM and change in Committee membership and that the Secretary was now himself\, Frank Holmes and Chairman was now Gary Spencer also in attendance at the meeting this evening. He noted that the side have secured 3 of the boundaries to the site but that works were ongoing to the west side of the site. He advised that the allotment association were considering a move away from a self-managed arrangement\, but this would be subject to further discussion and subsequent vote. He referred to ongoing issues with a plot holder that the association are addressing. \n  \n  \n\n GAINSBOROUGH IN BLOOM (Paper C)\n\n  \nThe report provided members with an update on the Group’s plans for 2019. \n  \nRESOLVED that members note the update. \n  \n  \n\n TENANCY AGREEMENTS \n\n  \nThe Clerk provided Secretaries with an update for their sites and noted the much-improved position. \n  \nRESOLVED that members note the update.                          \n  \n  \n\n LOVE LANE REQUEST (Paper D)\n\n  \nThe Secretary advised that the orchard works had been completed by the plot holders and there was no need for consideration of the request. \n  \n  \n\n SUB-COMMITTEE REMIT (Paper E)\n\n  \nThe Clerk summarised the report as previously circulated. \n             \nRESOLVED to note the changes to the subcommittee structure and functions as set out within Paper E. \n  \n  \nRESOLVED under Standing Order 10.a. xi to exclude the press and public. \n  \nNote: Councillor Panter arrived at 7.05pm. \n  \n  \n\n SHOWFIELDS REQUEST\n\n  \nMembers discussed the quotations received to date and the actual need for the works. The secretary requested that two significant areas of debris be cleared from plot 1. The Operations Manager agreed he would advise the grounds team to include on their schedule of works. \n  \n  \n\n SPITAL HILL ALLOTMENTS – MANAGEMENT MATTERS ARISING\n\n  \nThe Secretary advised the fence on Cox’s Hill side was showing signs of wear and needs several posts replacing. The Operations Manager agreed he would advise the grounds team to include on their schedule of works. \n  \n  \n\n LOVE LANE ALLOTMENTS – MANAGEMENT MATTERS ARISING\n\n  \nThe Secretary thanked the Operations Manager and grounds team for work carried out planting the gorse bushes. \n  \n  \n\n NORTH WARREN ALLOTMENTS – MANAGEMENT MATTERS ARISING\n\n  \nThe Secretary informed Members one plot holder had had his chickens stolen. He also advised of his attempts to contact the contractor approved to clear the site but to no avail. \nThe Operations Manager advised he would begin to look again for alternative contractor quotes. \n  \n  \n\n ALLOTMENT BUDGETS (Paper C)\n\n  \nThe Clerk informed Members that at the last Management and Finance Committee meeting Members recommended to Full Council to take £5\,000 from the £10\,033 allotment site ear marked reserves to put towards the urgent repairs of the showfield allotment wall. The Clerk advised that in the 2019/20 budget funds have been budgeted for to start a sinking fund for the future maintenance of the wall. \n  \nSecretaries raised concerns with regards to the use of the allotment site ear marked reserves. \n  \nRESOLVED that Members note the budget sheet and was advised to come forward with any projects for their sites. \n  \n  \n\n FOXBY HILL ALLOTMENT\n\n  \nThe Acting Secretary / Treasurer informed Members they have had recent issues regarding a former plot holder on the site\, which is now in Police hands. \nRefencing of both the Middlefield Lane and Foxby Lane side of the site is now complete and have received positive comments from members of the public. \nAn AGM will be held in March with the aim of appointing a new Secretary and to decide how to spend the 2019/20 rents within the site. \n  \n  \n\n 2020 / 2021 RENT REVIEW\n\n  \nMembers reviewed 2020 / 2021 allotment rents to make a proposal for consideration at Management and Finance Committee. Some Secretaries requested that the rent be rounded up to a whole pound figure. \n  \nRESOLVED TO RECOMMEND TO MANAGEMENT AND FINANCE COMMITTEE to increase the allotment rents for 2020 / 2021 to £27 from £26.50 \n  \n  \n\n GAINSBOROUGH IN BLOOM (GIB) SUPPORT \n\n  \nMembers considered the request for support from GIB in relation to use of allotments such as promotion and free plots to aid allotment take up. \n  \nShowfield Allotment Secretary advised that they felt seriously let down by GIB\, as they have entered in the past and the late former Secretary spent hours planting flowers round the site with support from plot holders to improve the site\, and on the day of judging the judges did not enter the site\, just looked over the gate. \n  \nSecretaries advised they would speak with their plot holders to see if the have any ideas to feedback to the Sub-Committee. \n  \n  \n\n TENANCY AGREEMENTS\n\n  \nThe Clerk advised that work had begun on ensuring all plot holders have an up to date allotment agreement and the Deputy Clerk would liaise with Secretaries direct. \n  \n  \n\n SPITAL HILL ALLOTMENT GATES (Paper C)\n\n  \n            RESOLVED under Standing Order 14n to exclude the press and public. \n  \nNote: Treasurer of Foxby Hill Allotment Association and Members of the public left the meeting. \n  \nMembers considered the quotations received to make alterations to Spital Hill allotment gates and fence\, making them up to 2m high with mesh fronts. \n  \nRESOLVED to RECOMMEND TO COMMUNITY SERVICES COMMITTEE to approve the quotation received by P.C’s to make alterations to Spital Hill allotment gates and fence\, making them up to 2m high with mesh fronts. \n  \nNote: Councillor Clarke abstained from voting on the above resolution. \nThe meeting concluded at 7.26pm.
